This website and online store are operated by Falster IoT ApS. Throughout these Terms of Service, the terms “we,” “us,” “our,” and “the Company” refer to Falster IoT ApS.

The technical e-commerce infrastructure for our online store is provided by Shopify.
These Terms of Service govern your access to and use of the Services, including purchases made through our online store.
Our Privacy Policy, Return and Refund Policy, Shipping and Delivery Policy, Payment Policy and other policies displayed through the online store also form part of the terms governing your use of the Services.
By accessing the website, creating an account, placing an order or otherwise using the Services, you agree to these Terms.
If you do not agree to these Terms, you should not use the Services.
Nothing in these Terms excludes or restricts any consumer right that cannot legally be waived under applicable consumer protection law.

3. Eligibility and Use of the Services
You may use the Services only if you are legally capable of entering into a binding agreement under the laws applicable to you.
By placing an order, you confirm that you have the legal capacity required to enter into the purchase agreement.
Where permitted by law, a minor may use the Services only with the involvement or supervision of a parent or legal guardian.
You agree to use the Services only for lawful purposes and in accordance with these Terms.
We may reasonably restrict or suspend access where we believe that a user:
- Has materially violated these Terms;
- Has provided false or misleading information;
- Is using the Services for fraudulent or unlawful purposes;
- Has attempted to compromise website or account security; or
- Creates a material risk to customers, the Company or third parties.

When creating an account or placing an order, you may be required to provide:

- Delivery address;
- Payment information; and
- Other information reasonably necessary to process your transaction.

You are responsible for maintaining the confidentiality of your account credentials.

You may not sell, transfer, assign or otherwise provide your customer account to another person without authorization.
5. Product Information
We take reasonable steps to ensure that product descriptions, specifications, prices and images displayed through our online store are accurate.
However, the appearance of a physical product may vary slightly because of:
- Screen or display settings;
- Device type;
- Lighting;
- Photography;
- Manufacturing variations; or
- Product updates.
Product images are intended to provide a reasonable representation of the product.
We do not guarantee that colors displayed on a particular screen will exactly match the physical product.
We may correct or update product information where necessary.
Nothing in this section affects mandatory rights relating to goods that are defective, incorrectly described or otherwise non-conforming.
6. Product Availability
All products are offered subject to availability.
Adding an item to your shopping cart does not reserve the product.
A product may become unavailable before an order has been processed or accepted.
If an ordered product becomes unavailable, we may, where appropriate:
- Cancel the affected product;
- Contact you for instructions;
- Offer an appropriate alternative; or
- Refund the amount paid for the unavailable product.
7. Placing an Order
Submitting an order constitutes an offer by you to purchase the selected products.
An automated order acknowledgment confirms that your order has been received but does not necessarily mean that it has been accepted.
A binding purchase agreement will normally be formed when we:
- Confirm acceptance of the order;
- Confirm dispatch of the order; or
- Otherwise expressly confirm that the order has been accepted.
Please review your order details carefully before submitting your order.
Once an order has entered processing or fulfilment, we may not be able to make requested changes or accept voluntary cancellation.
This does not affect any statutory cancellation or withdrawal right available to you.
8. Our Right to Reject or Cancel an Order
We may reject or cancel an order where reasonably necessary, including where:
- A product is unavailable;
- Payment cannot be authorized or verified;
- Billing or delivery information is incorrect;
- Fraudulent or unauthorized activity is reasonably suspected;
- There is an obvious pricing or product-information error;
- Applicable purchase limits have been exceeded;
- Delivery to the selected destination is unavailable; or
- Processing the transaction would violate applicable law.
If payment has already been collected for a cancelled order, the relevant amount will be refunded using the original payment method or another appropriate method where necessary.
9. Prices and Promotions
The price payable will normally be the price displayed when you submit your order.
Prices and promotional offers may change from time to time.
A subsequent price change will not normally affect an order that has already been accepted, except where an obvious pricing error occurred.
Promotional offers may have separate conditions relating to:
- Eligibility;
- Duration;
- Selected products;
- Minimum purchase requirements;
- Maximum quantities; or
- Usage limits.
Where specific promotion terms conflict with these Terms solely in relation to that promotion, the specific promotion terms will apply.
10. Taxes, Customs and Additional Charges
Applicable taxes, delivery charges and other amounts will be displayed during checkout where required and reasonably possible.
International orders may be subject to:
- VAT;
- Customs duties;
- Import taxes;
- Customs clearance fees;
- Handling charges; or
- Other charges imposed by authorities in the destination country.
Where such charges are included in the purchase price, this will be indicated during checkout.
Unless expressly stated otherwise, charges imposed directly by customs or other authorities in the destination country may be the customer's responsibility.
Customers are responsible for ensuring that the products they order may lawfully be imported into their destination country.
11. Payment
You agree to provide accurate billing and payment information.
By submitting payment information, you confirm that:
- You are authorized to use the selected payment method;
- The information provided is accurate; and
- You authorize the applicable payment provider to process the transaction.
Payments may be processed through Shopify, PayPal, banks, payment gateways or other authorized payment service providers, depending on the options displayed during checkout.
Available payment methods may vary according to destination, currency, order value or other operational factors.
We may delay or cancel an order if payment cannot reasonably be verified or authorized.
12. Order Confirmation
After placing an order, you will normally receive confirmation through the contact information provided during checkout.
Please review your order confirmation carefully.
If you notice an error in:
- Products ordered;
- Quantity;
- Delivery address;
- Billing information; or
- Other order information,
please contact us as soon as possible.
We cannot guarantee that an order can be changed after fulfilment has started.
13. Shipping and Delivery
Shipping and delivery are governed by our Shipping and Delivery Policy.
Delivery dates and periods displayed through the Services are estimates unless expressly stated as guaranteed.
Delivery may be affected by circumstances including:
- Carrier delays;
- Customs inspections;
- Public holidays;
- Incorrect delivery information;
- Severe weather;
- Transportation disruption;
- Regulatory restrictions;
- Strikes;
- Natural disasters; or
- Other circumstances outside our reasonable control.
You are responsible for providing an accurate and complete delivery address.
Where a delivery fails because the customer supplied an incorrect or incomplete address, reasonable additional delivery or return costs may be charged where permitted by law.
For consumer orders, risk of loss or damage generally passes when you, or a third party designated by you other than the carrier, take physical possession of the goods.
14. Returns and Right of Withdrawal
Returns, exchanges and refunds are governed by our Return and Refund Policy.
Consumers in the European Union or European Economic Area may have a statutory 14-day right of withdrawal for eligible distance purchases.
Where that right applies:
- You may withdraw without giving a reason;
- You must notify us within the applicable statutory period;
- The goods must be returned within the legally applicable period; and
- You may be responsible for the direct cost of returning the goods where this was properly disclosed before purchase.
Our voluntary 30-day return policy provides additional return options and does not reduce statutory consumer rights.
The reference Terms use the same separation between the statutory 14-day withdrawal right and the additional 30-day commercial return policy.
15. Refunds
Approved refunds will generally be made through the original payment method unless another method is agreed or required.
Refund processing may depend on:
- The type of return;
- The payment method;
- When the returned goods are received;
- When proof of return is provided; and
- Processing times of the applicable payment provider or financial institution.
Where a statutory withdrawal right applies, refunds will be handled within the applicable statutory period.
Where legally permitted, reimbursement may be withheld until the returned goods have been received or satisfactory evidence of return has been provided.

16. Intellectual Property
Content available through the Services may be protected by intellectual property laws.
Protected content may include:
- Business names;
- Logos;
- Product names;
- Product descriptions;
- Photographs;
- Graphics;
- Videos;
- Text;
- Designs;
- Website layouts;
- Software; and
- Icons.
Such content may belong to Falster IoT ApS, Shopify, our licensors, service providers or other rights holders.
Unless otherwise permitted by law or expressly authorized, you may not:
- Copy or reproduce protected content;
- Modify or adapt protected website content;
- Republish or distribute protected material;
- Create unauthorized derivative works;
- Commercially exploit protected content;
- Remove copyright or intellectual property notices;
- Use our content in a misleading manner; or
- Use protected business or brand materials without permission.
Nothing in these Terms transfers ownership of intellectual property to you.
17. Customer Reviews and Submitted Content
Where the Services allow you to submit reviews, comments, photographs, videos or other content, you retain ownership of your original content.
By submitting content for publication through the Services, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish and display that content for legitimate purposes connected with the Services, including:
- Displaying customer reviews;
- Operating the online store;
- Responding to feedback;
- Improving our Services; and
- Promoting our products or Services.
You confirm that submitted content:
- Is accurate to the best of your knowledge;
- Is owned by you or submitted with appropriate permission;
- Does not violate another person's rights;
- Is not unlawful or misleading;
- Is not abusive or defamatory;
- Does not contain malware; and
- Properly discloses incentives or compensation where legally required.
We may remove content that violates these Terms or applicable law.
18. Third-Party Tools and Services
The Services may include features, integrations or tools provided by independent third parties.
We may not own or control these third-party services.
Your use of an independent third-party service may be subject to that provider's own:
- Terms of service;
- Privacy policy;
- Payment conditions; and
- Operating rules.
To the extent permitted by law, we are not responsible for losses caused exclusively by an independent third-party service outside our reasonable control.
19. Third-Party Links
Our online store may contain links to third-party websites, applications or platforms.
We do not necessarily control or operate those services.
When you access an external service, its own terms and privacy practices may apply.
Transactions made directly with independent third parties are generally between you and the applicable third party.
20. Shopify
Our online store uses Shopify's e-commerce infrastructure.
Purchases through our store are made from Falster IoT ApS, unless expressly stated otherwise.
Shopify is the platform provider and is not the seller of the products offered by Falster IoT ApS.
Shopify may independently process certain information in accordance with its own policies and applicable law.
This distinction between the merchant and Shopify is specifically included in the supplied Terms reference.
21. Privacy
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Our Privacy Policy explains matters including:
- Information we collect;
- Why we process it;
- How information may be shared;
- How information may be retained;
- International data transfers; and
- Privacy rights available to customers.
22. Errors and Corrections
Information displayed through the Services may occasionally contain:
- Typographical errors;
- Incorrect prices;
- Outdated information;
- Incorrect delivery estimates;
- Availability errors; or
- Other inaccuracies.
We may correct inaccurate information when an error is identified.
Where an obvious error materially affects an order, we may contact you to:
- Proceed using corrected information;
- Offer an appropriate alternative; or
- Cancel the affected item and issue an appropriate refund.
Nothing in this section limits mandatory consumer rights.

- To infringe intellectual property or privacy rights;
- To harass, threaten or defame another person;
- To submit deliberately false or misleading information;
- To impersonate another person or business;
- To distribute spam or unauthorized advertising;
- To transmit viruses or malicious software;
- To obtain unauthorized access to an account or system;
- To interfere with website security or performance;
- To unlawfully collect personal information;
- To bypass security controls; or
- To commercially exploit protected Services without authorization.
We may reasonably investigate suspected misuse and restrict access where necessary.
The reference Terms contain substantially the same prohibited-use framework.
24. Automated Access
Automated software, bots or similar tools must not access the Services in a manner that:
- Circumvents security controls;
- Ignores technical access restrictions;
- Scrapes protected data without authorization;
- Obtains unauthorized account access;
- Interferes with website performance; or
- Otherwise violates these Terms.
We may use reasonable technical measures to protect the Services from harmful or unauthorized automated access.
25. Suspension or Termination
We may suspend or terminate access to the Services where reasonably necessary because:
- These Terms have been materially breached;
- Fraud or unlawful conduct is reasonably suspected;
- Payment remains lawfully unpaid;
- Website or account security is threatened;
- An account presents a material risk to others; or
- We are legally required to do so.
Where reasonably possible and legally appropriate, notice may be provided.
Termination does not affect rights or obligations that arose before termination.
26. Availability of the Services
We take reasonable steps to maintain the availability, security and accuracy of the Services.
However, we cannot guarantee that the website will always be:
- Uninterrupted;
- Free from temporary technical errors;
- Compatible with every device or browser; or
- Completely free from security risks.
Nothing in this provision reduces any statutory product guarantee or mandatory consumer right.
27. Limitation of Liability
To the maximum extent permitted by law, Falster IoT ApS will not be liable for indirect, incidental, special or consequential losses that were not reasonably foreseeable when the relevant contract was formed.
Depending on the circumstances, this may include indirect:
- Loss of profit;
- Loss of revenue;
- Loss of business opportunities;
- Loss of data; or
- Similar consequential losses.
Nothing in these Terms excludes or restricts liability where such exclusion is prohibited by law, including liability relating to:
- Fraud;
- Fraudulent misrepresentation;
- Intentional misconduct;
- Death or personal injury caused by negligence;
- Mandatory product liability;
- Non-waivable consumer rights; or
- Any other liability that cannot legally be excluded.
The supplied reference Terms expressly preserve these non-waivable liabilities.
28. Customer Responsibility for Breaches
To the extent permitted by law, you may be responsible for reasonable losses directly caused by:
- Your unlawful use of the Services;
- A material breach of these Terms;
- Your infringement of another person's rights; or
- Content submitted without the necessary rights or permission.
You are not responsible for losses resulting from our own unlawful conduct, breach or negligence.
29. Events Outside Our Reasonable Control
We will not be responsible for delays or failures caused solely by events outside our reasonable control.
Such events may include:
- Natural disasters;
- Extreme weather;
- War or civil unrest;
- Government action;
- Epidemics;
- Strikes;
- Transportation interruptions;
- Telecommunications failures;
- Power outages;
- Customs restrictions; or
- Failure of independent infrastructure.
Where such an event affects an order, we will take reasonable steps to reduce its impact where practicable.
Mandatory consumer rights remain unaffected.
30. Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, the relevant provision will apply to the fullest extent legally permitted.
The invalid part may be separated from the remaining Terms.
The remaining provisions will continue in effect.
31. No Waiver
A delay or failure by us to enforce a right does not mean that the right has been waived.
Any waiver applies only to the specific circumstances for which it is given.
32. Entire Agreement
These Terms, together with the policies incorporated by reference, form the agreement governing your access to and use of the Services.
They replace earlier versions relating to the same subject matter.
Nothing in this provision removes information, representations or rights that legally form part of a consumer purchase contract.
33. Assignment
You may not transfer your customer account or contractual obligations to another person without our prior authorization except where applicable law permits such transfer.
We may transfer our rights and obligations in connection with a legitimate:
- Sale of the business;
- Corporate restructuring;
- Merger; or
- Transfer of business assets.
Such a transfer will not reduce mandatory consumer rights.
34. Governing Law and Disputes
These Terms and purchases made through our online store are governed by the laws of Denmark, subject to applicable mandatory consumer protection rules.
If you are a consumer residing in another country, this choice of law does not deprive you of mandatory consumer protections that apply to you under the laws of your country of residence.
We encourage customers to contact us first if a dispute arises so that we can attempt to resolve the matter directly.

Where a dispute cannot be resolved directly, you may have the right to refer the matter to an appropriate consumer dispute-resolution body or competent court.
Nothing in these Terms requires a consumer to waive the right to bring a claim before a court that has jurisdiction under applicable consumer law.
35. Changes to These Terms
We may update these Terms from time to time to reflect:
- Changes to our Services;
- Changes in business operations;
- Changes in technology;
- Legal or regulatory requirements;
- Security developments; or
- Other legitimate operational reasons.
The latest version will be published through the online store with an updated effective date.
Where required by law, appropriate notice will be provided before a material change takes effect.
Changes will not retroactively remove rights arising from an existing purchase where doing so would not be legally permitted.
